David Powell

David has conducted building and construction litigation in all state courts and the Victorian Civil and Administrative Tribunal (VCAT) as well as arbitrations under the Commercial Arbitration Act.  He has acted for owners, builders, body corporates, owners’ corporations and developers.  In many instances, the litigation has been complex involving multiple parties, including builders, developers, architects, design engineers, geo-technical engineers, and building surveyors.  He has extensive experience in considering the apportionment of liability legislative regime and how it applies to small and large scale construction disputes.

He has an extensive range of building professionals to whom he seeks specialist expert advice where required.  Their fields of expertise include architecture, construction, engineering, waterproofing and building surveying.

He has conducted presentations to expert consultants on the preparation and presentation of their evidence before courts and tribunals.  More recently he has acted for large and medium scale (“off the plan”) developers of inner and near city developments.  He assists them with the drafting of their contracts and the resolution of various property issues arising during the pre-construction period and after.
